Unfit Conduct
That between January 2006 and May 2006, Lyn Jones, hereinafter referred to as ‘Ms Jones’, sold horses on behalf of four private customers of her livery business, known as ‘Coldicote Sports Horses’. Whilst agreeing to make the sales on their behalf for a small commission payment, instead Ms Jones sold the four horses and failed to transfer the balance of the monies received from the sales to their respective owners even after the deduction of her agreed commission. Also, two of the horses were sold without their respective owners being informed that they had been sold and the two owners subsequently found out about the sale when they became concerned that they had not heard from Ms Jones and she was then contacted. In addition, one of these two owners has stated that she had advised Ms Jones that she no longer wished her to sell her horse and yet Ms Jones moved her horse to new premises without notifying her and then sold her horse without consent. Ms Jones stated that she used the estimated £19,175 received (after commission payments had been deducted) from the sale of the horses to support her business, which was in financial difficulties.
