Enforcement Directorate

The Enforcement Directorate has a range of responsibilities dealing with misconduct and wrongdoing uncovered by official receiver’s or Insolvency Practitioners.

Enforcement Hotline

If a member of the public thinks that a disqualified director or a person subject to a Bankruptcy Restrictions Order or Undertaking is acting in breach of their disqualification or restrictions, they can complain by calling the Enforcement Hotline on 0845 601 3546.

Criminal Allegations Team

Official receivers (ORs) submit reports to the team alleging criminal offences they have discovered in bankruptcies and companies in compulsory liquidation. Insolvency practitioners (IPs) submit reports in voluntary liquidations. Where appropriate the team liaises with the BERR prosecuting authority to take forward the investigation and prosecution of these offences.

When an OR considers that a bankrupt should be subject to bankruptcy restrictions beyond their usual discharge date, they will submit a report seeking authority to apply to the court for a Bankruptcy Restrictions Order for 2-15 years. Where it is in the public interest, the team will authorise the OR to make this application.

Estate Accounts 

Estate Accounts section provides estates accounting and investment services for IPs and holds funds on behalf of official receivers.

Human Resources (HR) is responsible for reviewing, designing, and implementing HR policies, procedures and practices. It administers our personnel function and ensures we have a skilled, innovative, diverse and professional workforce.

Insolvency Practitioner Unit 

Insolvency Practitioner Unit (IPU) is responsible for all policy matters relating to the authorisation and regulation of insolvency practitioners (IPs), including the regulation of the Recognised Professional Bodies (RPBs). IPU is the main point of contact with the RPBs and other representative groups from the insolvency profession generally. The unit issues guidance to IPs and provides advice to Ministers, officials and the public on the regulation of IPs.

IPU is responsible for: 

  • reviewing IP disqualification reports;
  • the authorisation and regulation of IPs authorised by the Secretary of State (SoS), including monitoring their work and considering complaints against them;
  • ensuring that IPs comply with various statutory duties, including the submission of disqualification returns;
  • undertaking certain delegated functions on behalf of the SoS, such as 
    • maintaining the register of individual voluntary arrangements; 
    • dealing with applications for the agreement in principle of appointments of office holders; 
    • approving such applications; and 
    • dealing with applications to sanction the powers of trustees and liquidators in bankruptcy and compulsory liquidation where there is no creditors' committee; 
  • ensuring the accuracy of The Insolvency Service's database of cases and of IPs; and
  • monitoring the RPBs.

Policy

Policy Unit is responsible for all aspects of insolvency policy for England and Wales and for certain aspects of corporate insolvency policy in Scotland. It monitors the operation of insolvency legislation; provides advice to Ministers, officials and the public on insolvency policy; and considers the insolvency aspects of other legislation, including European Union initiatives.

Secretariat is responsible for taking forward Agency issues including:

  • customer service issues including Charter Mark; 
  • our User Satisfaction Index; 
  • the complaints procedure; 
  • other quality initiatives;

  • producing the Agency Annual Report and Accounts; and 
  • providing management support to our senior management.

Redundancy Payments 

Redundancy Payments HQ provides policy advice and briefing to Ministers, officials and other government departments on the employment aspects of redundancy, insolvency and employment status. It also deals with correspondence from the general public concerning redundancy matters.

Companies Investigation Branch (CIB)

Under the Companies Act, Companies Investigation Branch has the power to investigate companies. CIB investigations are confidential, and as a result company directors are not given specific reasons as to why CIB is investigating their company. As a result of statutory provisions CIB is unable to inform those who have complained about a company that it is carrying out an investigation or what, if anything, it has discovered during an investigation.
